Can you move a Statutory Holiday? Blog | October 30, 2014

Yes, it can be done. Well not moving a day, but you can substitute an alternative day at a later date.

We have a US based client that wanted to have their BC based Canadian offices open on a BC stat holiday (November 11) when their US offices were open, then closed when the US offices were closed for a US holiday (US Thanksgiving Nov. 27).

Section 48 of the BC Employment Standards Act provides that an employer, with the agreement of an employee, or the majority of the employees, as the case may be, may substitute another day off for a statutory holiday. An agreement between an employer and one employee is permissible.

Recently, an employee gave two weeks’ notice at the same time I was leaving for vacation. I contacted HRfx and provided them all the details to start the RPO process. When I returned after two weeks, I had several candidates to interview and I hired a great applicant from the short list that was given to me.
The HRfx team removed the stress off my plate and I could enjoy my vacation.
